What Set The Price
Three dates explain the repricing.
On August 8, Senate Majority Leader John Thune filed cloture on the motion to proceed to the Clarity Act before the August recess. That fixed the first procedural vote for 2:15 p.m. ET on Tuesday, September 15, the day after the Senate reconvenes.
On August 19, Trump pushed Congress to move on the bill at a White House meeting with executives from Coinbase, Ripple, Robinhood, and Kraken, plus SEC Chair Paul Atkins and CFTC Chair Michael Selig. "Now we need Congress to take the next step by passing the Clarity Act, a fair version of the Clarity Act," he said, without saying which provisions make a version fair.
On August 20, the CFTC's new Innovation Advisory Committee was scheduled to hold its first meeting, with crypto assets and prediction markets on the agenda, including what the agency can do by rule while Congress works.
Presidential pressure, a scheduled vote, and a regulator preparing for the aftermath should have lifted every rung of the ladder. They did not, because of what September 15 actually is.
What The September 15 Vote Decides
It is cloture on the motion to proceed. The Senate votes on whether to stop debating whether to start debating the bill. It takes 60 votes, and Republicans hold 53 seats, so a unanimous GOP still needs seven Democrats or independents.
Winning does not pass the Clarity Act or even begin debate on its text. It clears one gate of several: the motion to proceed itself, floor debate, an amendment fight over the provisions that have stalled talks for a year (ethics rules on officials profiting from crypto, anti-money-laundering language, DeFi carve-outs), a second 60-vote cloture on the bill, then final passage by simple majority. Whatever passes then has to be reconciled with the version the House approved in July 2025, because the Senate has been writing its own text.
Losing is not fatal either. A failed cloture vote can be rerun whenever Thune's whip count improves. The vote can advance the bill but cannot kill it, which is why the market treats it as a checkpoint.

The January 1, 2027 rung is the one the "does crypto get its rulebook this year" question settles on, and it is the most heavily traded contract on the board with a book one cent wide. It still read 22 cents with the White House pushing and a vote on the calendar. The endorsement everyone saw coming was already in the price.
Why The October Rung Fell While 2027 Rose
While November, December and every 2027 rung rose, the Before Oct 1, 2026 contract slipped from 9 cents to 8. Traders decided the bill is more likely to pass eventually and less likely to pass fast, because the news that mattered was the schedule. Once Thune's filing fixed September 15 as the starting gun, a pre-October signing was dead. The Senate's slowest process cannot start on September 15 and end at a signing ceremony two weeks later.
Walk the calendar forward. The Senate reconvenes September 14 and votes cloture September 15. Even if seven-plus Democrats cross, the amendment fights over ethics and illicit finance are the real negotiation, and a year of trying has not settled them. Clear all of that and the House still has to accept whatever the Senate changed.
Subtract each rung from the next and the fattest window on the board is the first half of 2027, at roughly 19 points. November and December together add about 6, which is a quiet insult to the lame-duck theory: the window where post-election Congresses attach stalled bills to must-pass vehicles is priced as a longshot. The market's modal story is a September vote that keeps the bill alive, a winter of negotiating, and a reconciled text reaching the president's desk in the first half of 2027, most plausibly with the new Congress seated.
What To Watch After September 15
The cloture count. Sixty-plus votes should lift the November and December rungs first, because it converts "alive" into "moving." A failed vote likely bleeds the 2026 rungs toward the September price while 2027 holds, since a rerun stays available and the market's base case already lives there.
The amendment texts. Ethics provisions, AML language, DeFi treatment, stablecoin rules. The first leaked compromise on any of them moves this ladder more than any speech, in either direction.
The November midterms. If the bill is not law by November, the makeup of the next Senate becomes the dominant variable; the 2026 midterm odds page tracks who controls the floor time the 41-cent July rung assumes.

The market got more bullish on passage and less bullish on speed, and the rung that fell is the one that read the Senate calendar correctly. Watch the 8-cent October rung on September 16. If cloture lands, that contract becomes the purest read on whether Washington intends to finish this year or merely keep trying. A 50-cent rung is priced to lose as often as it wins.
